On Friday, March 30, 2012, a Victoria County jury found Kristopher Durst guilty of six counts of aggravated assault with a deadly weapon. The same jury assessed 4 years imprisonment on each of the six counts on Monday, April 2nd. After a heated exchange of words with occupants in another car, the Mr. Durst fired a gun, with one bullet hitting the victim's car. No occupants were injured in the assault.

Assistant Criminal District Attorney Brian Hrach prosecuted the charge. "The toxic combination of impulsive youth, irrational emotions, false pride and a firearm in the hands of someone like Mr. Durst is dangerous." He added, "The victims used words and he retaliated with a gun." Steve Tyler said, "Mr. Durst had an absolute disregard for others and an arrogant display of lawlessness."
